Head of Section:
The section covers the State of Israel. It is run in cooperation with various criminal law experts in Israel.
Prior to its reform, Israel’s Penal Code was based on the Criminal Code of Cyprus of 1928, which, in turn, was based on the Queensland (Australia) Code of 1899, a code that reflected the judicial decisions of English common law. Israel’s new Penal Code, which entered into force in August 1995, represents a milestone in the development of Israeli criminal law. The inclusion in the new Code’s Preliminary Part of a provision codifying the principle of legality – a principle previously followed by the judiciary despite its lack of codification – is only one example of the extent of this reform.
