Scope and Main Areas of Research:

The section comprises Denmark, Finland, Norway, Sweden, and Iceland.

The Nordic countries are characterized by their reform affinity. As far as criminal policy and the development of modern sanctioning systems are concerned, they are considered exemplary. Their close cooperation in the area of international legal assistance in criminal law context serves as a model for Europe. Despite some common traits, the Nordic criminal law systems are marked by great independence. Several deeper differences can be seen with regard to the basics of the general theories, such as the concept of the criminal offense, attempt, complicity, and criminal capacity as a prerequisite for criminal liability. Significant differences can also be found in the area of criminal procedure with regard to the principles of mandatory and discretionary prosecution.

Recently, the main focus of the section has been on the criminal law aspects of press and media law in Sweden. Swedish regulations on the freedom of information date back to the year 1766 and are accompanied by an extensive protection of informants in the public sector. Sweden is considered a pioneering country in terms of transparency. It protects the constitutional principle of openness - by means, for example, of an exclusive and restrictive list of press and media offenses - as well as the right to anonymity. The section has also conducted research on the criminal prohibition of investigating who has leaked information to the media and on the criminal prohibition of carrying out reprisals against someone who has exercised his or her right to freedom of the press.
